1. Scope

(1) These Terms and Conditions ("Terms") apply to all contracts entered into through the online shop at deanshop.com between the operator of deanshop.com (hereinafter "DEAN SHOP", "we", "us") and the customer (hereinafter "you", "Customer"). Our product range covers items in the home and garden categories.

(2) A consumer for the purposes of these Terms is any natural person entering into a legal transaction for purposes which can predominantly not be attributed to commercial or self-employed professional activity. A business customer is any natural or legal person or partnership with legal capacity acting in their commercial or self-employed professional capacity when entering into the contract.

(3) Conflicting, different or supplementary terms of the Customer shall only become part of the contract if their applicability has been expressly confirmed by us in writing.

2. Contracting Party and Contact

3. Conclusion of Contract

(1) The presentation of our home and garden products in the online shop is not a legally binding offer but serves exclusively as a non-binding online catalogue.

(2) By clicking the "Buy" / "Place order" / "Pay now" button, you submit a binding offer to purchase the items contained in your shopping basket.

(3) Acknowledgement of receipt and acceptance of the order occur simultaneously — you receive these immediately after submission of your order by means of an automatically generated email. With the dispatch of this confirmation email, the contract of sale becomes legally binding.

(4) We store the contract text and send it to you together with these Terms by email. The Terms currently in force can also be viewed at any time at deanshop.com/terms-of-service.

(5) Contracts are concluded in the English language.

4. Prices and Shipping Costs

(1) All prices displayed on the website include the applicable statutory Value Added Tax. Any additional shipping and delivery costs are shown separately during the ordering process.

(2) For deliveries to countries outside the European Union and the United Kingdom, additional customs duties, taxes and other charges may apply, which must be paid by the Customer.

5. Payment Terms

(1) The following payment methods are available: credit card (Visa, Mastercard, American Express), PayPal, Klarna, Apple Pay, Google Pay and bank transfer. We reserve the right not to offer individual payment methods in specific cases.

(2) The purchase price is due for payment upon conclusion of the contract.

(3) When paying by credit card or PayPal, your payment account will be charged immediately upon completion of the order.

6. Delivery

(1) Delivery is made to the delivery address provided by the Customer. The respective delivery times are clearly displayed on the relevant product page as well as during the ordering process.

(2) Should delivery not be possible despite three delivery attempts, we are entitled to withdraw from the contract. Any payments already made will be refunded to you without delay in such cases.

(3) In the event of delays caused by force majeure, the delivery period shall be extended accordingly. We will inform you promptly of any such delays.

7. Retention of Title

The delivered goods remain our property until the purchase price has been paid in full.

8. Right of Cancellation for Consumers

Consumers are entitled to a statutory right of cancellation. Detailed cancellation information together with the model cancellation form can be found on our Cancellation Policy page.

9. Warranty and Liability for Defects

(1) The statutory provisions on liability for defects apply. For consumers, the limitation period for claims arising from defects in the goods is two years from delivery.

(2) For used goods, the limitation period is reduced to one year from the delivery date.

10. Liability

(1) We shall be liable without limitation in cases of intent and gross negligence as well as within the framework of consumer protection legislation.

(2) In cases of simple negligence, we shall only be liable for breach of a material contractual obligation (a so-called cardinal obligation), the fulfilment of which is essential for the proper performance of the contract and on the observance of which the Customer regularly relies. In such cases, liability is limited in amount to foreseeable damages typical of the contract.

(3) This shall not affect our liability for injury to life, body or health.

11. Dispute Resolution

(1) The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

12. Applicable Law and Jurisdiction

(1) The contractual relationship shall be governed exclusively by the laws of England and Wales, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. As regards consumers, this choice of law shall only apply to the extent that the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence is not thereby withdrawn.

(2) If the Customer is a merchant, a legal person under public law or a special fund under public law, the place of our registered office shall be the place of jurisdiction for all disputes arising from this contractual relationship.

13. Final Provisions

Should any individual provisions of these Terms be or become invalid in whole or in part, the validity of the remaining provisions shall not be affected. The relevant statutory provision shall replace any invalid provision.
